The Bench hearing the matter in the Supreme Court said that the CBSE has not given any rationale behind the policy of considering the marks obtained in the improved examination as final. The court said on its decision that if the students have to choose only the marks obtained in the main examination, then they will be given the right to do so. This is okay because if a student gives an improvement exam and his marks fall short, then the students may face difficulty in taking further admission. So it is better that students have the right to choose their better marks.

But the Supreme Court has directed to implement the same policy in this matter so that the students do not face any kind of problem in future for further studies.
