He stated that the state cabinet, under Article 163 of the Constitution, is empowered to provide assistance and advice to the Governor, and they are exercising this authority to facilitate a smoother judicial process. Patil confirmed that recommendations would be sent to the Governor regarding the four ongoing cases, of which charges have been filed in two.

The Governor’s Obligation to Consider Recommendations

Patil further explained that the Governor is obligated to consider the recommendations from the cabinet and that the scope of the Governor’s discretion is limited. He expressed confidence that the Governor would utilize his discretion judiciously. There are several pending petitions before the Governor seeking approval for prosecution, with some cases already having filed charges, including one notable petition against Shashikala Jole, submitted to the Lokayukta police on December 9, 2021.

Status of Ongoing Investigations

One of the petitions pertains specifically to Kumaraswamy. An application regarding his case was submitted on November 21, 2023, requesting approval under Section 19 of the Prevention of Corruption Act and related provisions of the BNS Act. The Special Investigation Team (SIT) has already filed its charge sheet in this matter. Following a request for clarification from the Governor on July 29 of this year, the SIT responded on August 16, confirming the details of their findings.
